These terms and conditions (the “Terms and Conditions”) apply to the entire contents of the DataCo Website and to any correspondence by e-mail between DataCo and the users of the DataCo Website.

Introduction

DataCo is entitled to change these Terms and Conditions at any time. Every time you wish to use the DataCo Website you should check the Terms and Conditions to ensure that you accept them. Please note that certain provisions in these Terms and Conditions may be superseded by expressly designated terms located on particular pages of the DataCo Website.

Your use of the DataCo Website

2.1 You agree:

2.1.1 to abide by all applicable laws, regulations and codes of conduct that may apply to the DataCo Website and to be solely responsible for all and any liability arising from your use of the DataCo Website;

2.1.2 not to damage, interfere with or disrupt access to the DataCo Website or do anything that may interrupt or impair its functionality;

3.1 If you have an i-PBS login you will be permitted to access restricted sections of the DataCo Website and your use of the DataCo Website will be subject to the additional terms set out in clause 4 (Media Accreditation).

3.2 You may only print and/or download application forms and other information from the DataCo Website for the purpose of completing and submitting an application for media accreditation. You may not alter the application forms under any circumstances.

3.3 The copyright, database rights, trademarks and any other intellectual property rights in any material on the DataCo Website are owned by DataCo or its licensors. For the purposes of these Terms and Conditions, any use of extracts from the DataCo Website other than in accordance with these Terms and Conditions for any purpose is prohibited. If you breach any of these Terms and Conditions, your permission to use the DataCo Website will automatically terminate and you must immediately destroy any downloaded or printed extracts from the DataCo Website.

3.4 Subject to clause 3.2, no part of the DataCo Website may be reproduced, stored or transmitted in any form (including in any public or private electronic retrieval system or service) without DataCo’s prior written permission.

3.5 Any rights not expressly granted in these Terms and Conditions are reserved.

3.6 The content on the DataCo Website is provided for general information only. It is not intended to amount to advice which you should rely on.

Media Accreditation

4.1 The terms in this clause 4 will only apply to you if you are applying for, or have been granted, media accreditation. If you have an i-PBS login you will be permitted access to restricted sections of the DataCo Website.

4.2 If you choose (or you are provided with) an i-PBS login, password or any other piece of information as part of the DataCo Website security procedures, you must treat such information as confidential and you must not disclose it to any third party.

4.3 In the course of applying for media accreditation from DataCo through the DataCo Website, you may submit personal data that will be processed by DataCo in line with DataCo’s Privacy Policy and on behalf of the Football Association Premier League Limited, The Football League Limited and the Scottish Professional Football League (together with their group companies) (each a “Relevant League”) for the following purposes:

4.3.1 deciding whether or not to grant you access to a football match;

4.3.2 to comply with and enforce its contractual rights and obligations arising under the accreditation; and

4.3.3 sharing with football clubs for administrative purposes (such as gaining admission to football grounds).

4.5 DataCo, any other party (whether or not involved in creating, producing, maintaining or delivering the DataCo Website), and any of DataCo’s group companies and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the DataCo Website in any way or in connection with the use, inability to use or the results of use of the DataCo Website, any websites linked to, or from, the DataCo Website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the DataCo Website or your downloading of any material from the DataCo Website or any websites linked to the DataCo Website.

4.7 You agree to indemnify DataCo (and its officers, employees, agents or associates) against any loss, liability, damage, cost, expense, claim or injury threatened against, incurred or suffered by DataCo as a result of your failure to comply with any of the Terms and Conditions or your improper or unlawful use of the DataCo Website.

Service Access

5.1 While DataCo endeavours to ensure that the DataCo Website is normally available 24 hours a day, DataCo shall not be liable if for any reason the DataCo Website is unavailable at any time or for any period.

5.2 Access to the DataCo Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond DataCo’s control.

These Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.
